Dan Atkinson and Spencer Barrow obtained a defense verdict in a weeklong trial in Greenville County. The case involved claims of negligence and breach of contract by a commercial property owner against a South Carolina engineering firm. The plaintiff claimed over $10,000,000 in damages, alleging negligence, breach of contract, and unfair trade practices, related to special exception zoning permit services provided. WAJ defended the claim, noting that its client had complied with the applicable standard of care, as well as all terms of the contract. WAJ obtained a directed verdict on the gross negligence and unfair trade practices claims, and it obtained a jury verdict on the negligence and breach of contract causes of action.
